1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of the Grapeit mobile application and website (the "Service") provided by Grapeit AB ("Grapeit", "we", or "us"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
Grapeit is a wine analysis and education service. It helps you identify grape varieties from your sensory observations, track your tasting progress, and learn about wine. The Service is intended for educational purposes. We may add, change, or remove features at any time.
3. Eligibility and Accounts
You must be at least 18 years old, or the legal drinking age in your jurisdiction, whichever is higher, to use the Service. You are responsible for the accuracy of your account information and for keeping your credentials confidential. You must comply with all applicable laws, including laws regarding alcohol in your jurisdiction.
4. User Content
Analyses, notes, and other content you create in the Service ("User Content") remain yours. You grant Grapeit a worldwide, non-exclusive, royalty-free license to host, store, and process your User Content solely to operate and provide the Service. You represent that you hold the rights needed to grant this license.
5. Acceptable Use
You may not: (a) use the Service for any unlawful purpose or in violation of these Terms; (b) interfere with or disrupt the Service or its infrastructure; (c) attempt to gain unauthorized access to the Service, other accounts, or our systems; (d) scrape or reverse engineer the Service except as permitted by applicable law; (e) resell or sublicense access to the Service; or (f) encourage excessive or irresponsible alcohol consumption. Always consume alcohol responsibly and never drink and drive.
6. Purchases and Subscriptions
Some features may require payment. Purchases and subscriptions are processed and billed by Apple (App Store) or Google (Google Play) under their respective payment terms. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period through your App Store or Google Play account settings. Refunds are handled by Apple or Google under their store policies. We may change prices, with advance notice as required by the applicable store.
7. Intellectual Property
The Service, including its software, design, wine reference data, and content provided by Grapeit, is owned by Grapeit or its licensors and is protected by intellectual property laws. These Terms grant you a limited, revocable, non-exclusive, non-transferable license to use the Service for personal, non-commercial use.
8. Availability and Changes
We do not guarantee that the Service will be uninterrupted or error-free. We may modify, suspend, or discontinue any part of the Service at any time. Educational content and reference data are provided for learning purposes and may contain errors.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Grapeit does not warrant that grape identification results or other AI-generated content are accurate or complete; such results are educational estimates, not professional wine advice.
10. Limitation of Liability
To the maximum extent permitted by law, Grapeit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits or data, arising from or related to your use of the Service. Our total liability for all claims shall not exceed the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim.
11. Termination
We may suspend or terminate your account if you violate these Terms or applicable law. You may stop using the Service at any time. Sections that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, survive.
12. App Store and Google Play Provisions
These Terms are between you and Grapeit AB. Apple Inc. and Google LLC are not parties to these Terms and have no responsibility for the Service. In accordance with the requirements of the Apple App Store and Google Play: (a) Apple and Google have no obligation to furnish maintenance and support services for the Service; (b) Apple and Google are not responsible for addressing any claims relating to the Service, including product liability, legal, or regulatory claims; (c) Apple and Google are not responsible for any warranty obligations for the Service; and (d) Apple and Google are not responsible for the investigation, defense, settlement, or discharge of any third-party claim that the Service infringes intellectual property rights.
13. Changes to These Terms
We may update these Terms from time to time. The updated version is published on this page with a new "Last updated" date. By continuing to use the Service after changes take effect, you accept the updated Terms.
